Our specialist animal injuries team recover £45,000 compensation for a cow attack.
This is a case summary of a claim we recently dealt with in which our lawyers recovered compensation for a cow attack that left our client with serious injuries.
A seemingly innocent leisurely walk turned into a nightmare for our client. Accompanied by her pet dog, she and a group of friends were traversing the Wet Sleddale circular walk when they encountered a group of obstructive cows on the public highway.
Their initial attempt to persuade the cows to move aside proved unsuccessful, and as tensions rose, one of the cows attacked. Our client was swiped to her knees and head-butted in the chest, The cow then pushed across the road and trampled on her. The attack left her with severe injuries to her left wrist, sternum, spleen, and kidney, accompanied by psychological distress.
Emergency services were summoned, and our client was swiftly transported to the hospital, where the extent of her injuries became apparent. With lacerations to her spleen and kidney detected via CT scan, she underwent a series of treatments and surgeries, including a complex procedure on her fractured wrist. The physical injuries, coupled with the psychological scars, necessitated ongoing medical care and therapy.
Legal proceedings ensued as our animal injury team took up her case. Despite an initial denial of liability by the owner of the cows, subsequent investigations and expert assessments led to an admission of fault.
A clinical psychologist diagnosed our client as suffering from Post-Traumatic Stress Disorder (PTSD). This diagnosis meant that she required specialised therapy to aid her recovery. Additionally, an orthopaedic consultant and a plastic surgeon addressed the long-term implications of her injuries, including the permanent scarring and the need for ongoing cosmetic care.
Our legal team presented all the evidence, and ultimately an out of court settlement was reached, with the owner of the cows agreeing to pay compensation totalling £45,000 in addition to covering our client’s reasonable costs.
This case serves as a reminder of the potential danger that cows can present It underscores the importance of legal recourse in seeking justice and accountability, especially in cases where the consequences are as severe and far-reaching as those experienced by the claimant in this instance.
