This is a case study of a successful work injury compensation that we have recently concluded.
Our client, Ms B, was employed as an assistant site manager for the Defendant.
A group of workers had been assembling five sheds on site in close proximity to Mrs B’s office. Once completed, they loaded the 20 remaining wooden panels onto their van to transfer to another site.
As the van drove away, the panels slipped from the back of the vehicle, striking Ms B as she was leaving her office. The panels crushed her leg underneath their weight and one of the wooden panels contained a stray nail, which caused a deep gash to the back of Mrs B’s leg.
It was discovered that the workers had failed to correctly secure the wooden panels to the back of their van before setting off.
As the nail had remnants of both dirt and bacteria, the wound became infected, requiring emergency surgery to remove the infected tissue.

A claim was submitted to Ms B’s employers who promptly admitted responsibility for the accident. They accepted that the wooden panels had not been properly secured to the van and were therefore at fault.

Once these medical report had been obtained and Ms B’s financial losses had been fully calculated, an out of court settlement of Mrs B’s personal injury claim was agreed at £29,000.
