A delay in diagnosis is one of the most common types of negligence claim that we deal with. Delays in diagnosing a medical condition can not only impact whether, or how quickly, you can receive treatment, but they can have serious consequences for your health and lifestyle.

What is delayed diagnosis?

If a medical professional checks over a patient but fails to diagnose a medical condition that should have been identified, or does not investigate the symptoms further when they should do so, the patient’s health can be impaired. In some cases it can lead to a more serious condition developing that might have been prevented had treatment been given earlier.

Some examples of delayed diagnosis are:

  • Symptoms being ignored and not investigated
  • The correct scans/tests not being completed
  • A late referral to a specialist
  • Misdiagnosis – Been given a different diagnosis and therefore, the wrong treatment.
  • Test results have been incorrectly analysed, or not responded too appropriately.

Can you take legal action for a delayed diagnosis?

Legal action can be taken when it can be shown that but for the delay, treatment could have been given that would likely have resolved the condition or prevented it from worsening.

Our medical negligence team have a wealth of knowledge and experience in handling delayed diagnosis claims. Head of department, Oliver Thorne, recently settled a case for his client who suffered from a late diagnosis of endometrial cancer after her scan results were not read properly. We have also settled cases for misdiagnosis by a GP, and the late diagnosis of bowel cancer.

The impact of delayed diagnosis and not being given the correct treatment at the right time includes, additional pain and suffering, psychological injury, the cost ot treatment and care, and other financial losses.

In some cases early death can result, and if someone has sadly passed away as a result of medical negligence, then their spouse or child could bring the claim.
