What is a claim for the loss of a testicle worth?
Medical negligence lawyer, Oliver Thorne, answers the question, ‘How much compensation do you get for losing a testicle?’
The loss of a testicle due to a medical error is likely to give rise to a clinical negligence claim. But how much compensation can you expect to be awarded for losing a testicle?
The starting point is the award for what solicitors refer to as ‘pain and suffering’. According to the guidance issued to judges in England and Wales the award for loss of a testicle is currently (2024) between £24,490 and £27,560. This assumes that the patient has suffered some psychological consequences, but has not lost any sexual function or suffered impotence. Where the psychological impact is greater or where the patient’s sexual function has been impaired, or where they suffer impotence, then the award will be greater.
However, this is just the starting point of any testicular compensation claim we will pursue.
When presenting the claim we will also factor in the fertility risks of only having one testicle and the potential consequences of suffering injury or damage to the remaining testicle. We can therefore add in the cost of having your semen frozen and stored.
Another claim we can make is for the cost of having a prosthetic implant. There is a minor chance of the implant causing discomfort or infection and needing to be removed, so we build into our calculations a ‘pain and suffering’ award for the risk of that happening.
If you have worries about infertility, or you are particularly self-conscious about having one testicle, then you may benefit from a course of therapy and we can add the cost of that treatment to your compensation claim.
In addition, we will recover the value of any care you have received from friends and family, together with the costs of medication, travelling expenses and other out of pocket expenses you have incurred.
Once all these claims are factored in, the total compensation package that we will seek to recover could easily rise to more than £50,000.
