The Court of Appeal has announced that the level of compensation payable to personal injury claimants is to be increased by 10% from 1st April 2013. This increase will be applied to all judgements made after this date irrespective of when the injury was sustained.
The increase will only apply to the pain, suffering and loss of amenity (PSLA) element of the compensation claim. This is known by lawyers as general damages. The method of calculating out of pocket losses and expenses incurred as a result of the accident (special damages) will remain unchanged.
The 10% increase in compensation forms one element of a raft of changes to the way injury claims are dealt with, which are being introduced next April as a result of the introduction of the Legal Aid, Sentencing and Punishment of Offenders Act 2012.
