It is not uncommon for people who are making a personal injury claim to be told by their solicitors that their case is unlikely to succeed, and they are unable to continue dealing with it. However, when this happens, it does not necessarily mean that you must abandon your claim. Our specialist lawyers have an excellent record of taking over claims and getting results where other firms have failed.

Some of the questions you may have when considering if it is worth taking your case to new firm may include:

First, we offer a free second opinion on any injury claim. So, it costs nothing to ask.

If we agree to take over your claim, we will likely offer to work on a No Win No Fee basis. Part of this involves us agreeing a ‘lien’ on the costs incurred with your previous solicitors. In simple terms, this means we will seek to recover your previous solicitors’ costs on their behalf from the losing party at the conclusion of your claim. It also means that it will not involve you in any expense when transferring, and our success fee will only be charged if you win your claim.

While it can be helpful to notify your previous solicitors when a decision has been made to transfer your file to us, it is not essential. Once you have signed a form of authority, we can request your file of papers directly from your previous solicitors.

We have had a number of very successful outcomes in personal injury claims which other firms have rejected on the basis that the prospects of success were insufficient. For example:

  • A nine-year-old girl was bitten on the face by a dog. Two firms of solicitors told her parents that she did not have a claim. Our specialist injury lawyers took a different view, and went on to recover £36,000 in compensation.
  • A courier bitten by a dog was told that due to the dog having no previous history of aggression, he would be unable to make a claim. This advice was wrong, and after instructing our firm, we secured a compensation package that included a substantial loss of earnings claim.
  • Following a denial of liability, our client’s previous solicitors confirmed they would no longer be willing to act. After speaking to solicitor James McNally, a No Win No Fee agreement was offered to the client, and James went on to successfully reach an out of court settlement.
  • After becoming dissatisfied with her solicitor’s advice on an road accident claim, we were asked for a second opinion and then took over the case. We were subsequently successful in recovering compensation for our client.
