The circumstances of the workplace accident

Our client, Mr A, worked in a pub kitchen. On the day of the incident, a sous chef had transferred boiling liquid into plastic containers with side handles – originally intended for the storage of mayonnaise. This was an unsafe practice that had been followed for over a year. Despite being advised not to use the handles due to the risk of expansion from heat, a colleague lifted the containers by the handle, resulting in one of the handles snapping. The boiling liquid came into contact with Mr A’s legs and feet.

Although his jeans provided some protection, his trainers filled with scalding liquid, causing extensive burns to his foot and lower leg. He received immediate first aid and was taken to hospital, where he underwent emergency treatment.

Unfortunately, complications arose, and his injuries required further specialist care, including a skin graft procedure. In the weeks following, Mr A developed an infection at the graft site, leading to additional medical intervention and an extended recovery period.

The employer’s liability for the accident at work

Recognising the severe impact of the injury on his health and ability to work, Mr A turned to ourselves for legal assistance in pursuing a work injury compensation claim on a no win, no fee basis. From the outset, personal injury lawyer Carly Sylvester provided clear, strategic guidance, ensuring that Mr A understood his rights and the legal process. She built a compelling case against the pub’s management, highlighting multiple breaches of health and safety regulations, including:

  • Failure to provide a safe working environment – The continued use of unsuitable containers for boiling liquids posed a foreseeable hazard.
  • Inadequate risk assessments – No formal safety review had been conducted to identify and mitigate risks in food preparation areas.
  • Insufficient training – Staff had not been given appropriate guidance on the safe handling of hot liquids, increasing the likelihood of an incident.

We also gathered extensive medical reports and photographic evidence to illustrate the long-term consequences of his injuries, including scarring, ongoing pain, and mobility issues.

Out of court settlement of the accident claim

Despite the strength of the case, the pub’s insurers attempted to settle the claim for a sum that did not fully reflect the severity of Mr A’s injuries or his financial losses. However, Carly advised her client not to accept an inadequate offer and went on to successfully negotiate an improved package of £25,500. The settlement represented fair compensation for Mr A’s pain, suffering, medical expenses, and future care needs.

Our client’s review of the service he received

Mr A was grateful for Carly’s expertise in handling his burn accident at work claim, commenting on her approachability and commitment to client care. Reflecting on the support he received he said:

“Carly was fantastic from start to finish. She explained everything clearly, kept me updated, and fought to ensure I wasn’t pressured into accepting a lower settlement. Thanks to her, I can now focus on my recovery without financial stress.”

This case underlines the legal responsibility that employers have to maintain a safe working environment. Had proper risk assessments been conducted and appropriate equipment provided, Mr A’s injuries could have been avoided. It is crucial that businesses take proactive steps to ensure the safety of their employees and prevent similar incidents from occurring.
