Our client had been approaching a bend when he saw a car approaching in the opposite direction on the wrong side of the road. There was nothing he could do to prevent the other vehicle crashing into the front of his car.

Police attended the scene and our client was transported to hospital with injuries to his collarbone, ribs and shoulder. He also experienced shock as a result of the incident.

We sent a Claim Notification Form to the offending driver’s insurers, setting out formal allegations that their driver had:

  • failed to keep proper lookout;
  • failed to heed the presence of our client’s vehicle; and

Liability was swiftly admitted by the driver’s insurers.

This enabled us to proceed with instructing a GP to meet with our client and assess his injuries in greater detail. This resulted in a recommendation of a referral to psychologist for an examination of the effect of the accident on our client’s mental health, and a course of physiotherapy to assist with his ongoing shoulder pain.

The psychologist we instructed concluded that our client had suffered ‘stress and mood disturbance’, as well as car accident anxiety which he thought would improve over time.

We requested and obtained an interim payment from the offending driver’s insurers to enable our client to pay for the private medical treatment that had been recommended.

After organising a course of physiotherapy, we ensured that our client felt improvement in his shoulder before considering settlement of the claim for compensation. We drafted a Schedule which set out his financial losses, including travel to medical appointments, medication costs, and future medical expenses.

An offer to settle the claim was presented to the Defendant’s insurers, along with our supporting medical evidence and the Schedule of Loss. This resulted in the case being settled out of court following a short period of negotiation.
