We are often approached by people who want to know how to make a claim if you are injured on a bus. Here is a brief guide to the law.
Over the years we have dealt with many clients who have been injured on a bus while they have been travelling as a passenger.
Where a bus accident occurs as a result of a mistake by the bus driver or the actions of another road user, the injured passenger may well be entitled to make a legal claim for compensation.
One particularly common type of accident is where a passenger suffers injury due the bus driving off or stopping suddenly. Bus drivers should be aware that they may have passengers on board who are unsteady on their feet or vulnerable. They therefore need to avoid sudden movements to avoid the risk of a passenger falling over. In these cases we may be able to bring a claim against the bus company or their insurers.
In other cases where the bus driver is forced to stop suddenly or swerve due to the actions of another road user we can make the claim against the driver who is at fault. For example, we have made successful claims for people who have been injured on a bus which was forced to make an emergency stop due to another driver pulling out unexpectedly in front of it. In these situations the bus company is not responsible for accident as their driver was simply avoiding a collision. It helps if you can get the other driver’s details, but don’t worry if you are not able to as these days most buses are fitted with CCTV, covering both the inside and outside of the bus. We can often use this to identify the vehicle that was responsible for the accident. Once we have reviewed the CCTV and have confirmed who the responsible party is we can then submit the claim to the relevant insurers.
