Compensation recovered for a young boy following an accident at a soft play centre.
This is a real-life case summary of an accident at a soft play centre which resulted in a successful compensation claim being made.
The boy (who we shall call ‘P’) had attended the soft play centre with his family. After reaching the top of a climbing wall, he spotted a nearby rail, suspended from the ceiling. Mistaking the rail as part of the soft play apparatus, he grabbed it with his hand. The metal rail, which had live electricity running through it, snapped. P sustained an electrical shock, causing him to fall from the six foot wall.
The electrical shock caused burns to his palm and finger. Treatment consisted on removal of the dead, burnt skin, and multiple weekly appointments with a nurse to dress the injury.
P’s parents were distraught over the incident, and concerned that something like this could just be overlooked. They decided to seek legal advice, and contacted our free legal helpline for a consultation. After hearing about P’s injury, lawyer Carly Sylvester was happy to offer assistance in bringing a claim on a No Win, No Fee basis.
Following the submission of a claim, liability for the accident was denied, with the soft play centre claiming the hanging rail was not a reasonable hazard for a child. Despite the denial, Carly persisted with the claim, obtaining medical evidence from both a plastic surgeon and a psychologist, with the intention to bringing this matter to court.
Thankfully, due to Carly’s expertise and negotiation skills, an out of court compensation settlement was ultimately reached.
