Our award-winning personal injury team has once again won compensation for a dog bite. On this occasion it involved a woman who had been bitten by a dog while she was jogging in her local park.
As the lady passed a group of dogs being walked by a dog walker one of the dogs – which was on a long lead – bit her on the leg.
The lady, who we will refer to as M contacted our personal injury department to find out more about her options. Partner Elizabeth Duncan agreed to make a compensation claim on her behalf and to work on a No Win No Fee basis.
In M’s case, there were two possible defendants, the dog owners and the dog walkers. Elizabeth therefore contacted both possible defendants.
The dog owner denied liability on the basis that the dog was in the charge of a professional service. The dog walking company also denied liability for what had happened claiming that the circumstances were beyond their control.
Undeterred. Elizabeth pressed on with the legal claim, obtaining medical evidence about the injuries sustained by M, both physically and psychologically, and continued to press both defendants to deal with things more sensibly.
Her tenacity paid off with one of the defendants ultimately accepting liability. After a period of negotiation, an out of court settlement was reached in which M received compensation for her injuries and financial losses.
